Klaas J. Kraay argues that the rational choice model for divine creation—according to which God chooses to actualize one world among possible alternatives based on its axiological properties—cannot succeed given failures of comparability across possible worlds. I argue that failure of comparability across worlds would not undermine the rationality of choosing one world to create among possible alternatives.

For forty years, Harvey Mansfield has been worth reading. In “The Natural Ontological Attitude,” Arthur Fine attempts to provide a way out of the realist/antirealist dichotomy in philosophy of science. Says Fine, the natural way of treating the ontological status of theoretical entities is not to form speculative metaphysical theories, be they realist or antirealist, but instead is to apply a homely version of Tarskian semantics. I argue that Fine’s position depends on two deficient maxims, and therefore does not provide a compelling way out of the realist/antirealist dichotomy. (...) Fine’s Maxim (FM) prohibits the possibility of inferring justified metaphysical theses from the truth-value of existence claims. Hilbert’s Maxim (HM) asserts that metatheoretic arguments are cogent only if they adhere to stricter standards than their constituent theories. I argue that (FM) is likely false, but even if true cannot be rationally believed. I further argue that (HM) is a deficient standard for theory justification due to the problem of infinite regress. Arthura Kaufmanna filozofia prawa wyrasta przede wszystkim z neokantyzmu aksjologicznego reprezentowanego przez „późnego” Gustava Radbrucha, którego uważał on za najważniejszego ze swych nauczycieli, oraz z hermeneutyki filozoficznej Hansa-Georga Gadamera. W późniejszym okresie znaczący wpływ na Kaufmanna wywarł Charles S. Peirce, którego pracami posiłkował się opracowując problematykę analogii (wiążąc ją z opracowanym przez Pierca zagadnieniem abdukcji) oraz ontologii relacji. Niektóre wątki poglądów Kaufmanna nawiązują do egzystencjalizmu Karla Jaspersa oraz antropologii Karla Löwitha. Obecne są także inspiracje tomistyczne i arystotelesowskie. Jest to filozofia (...) prawa o charakterze maksymalistycznym. Kaufmann wpisuje się w sięgającą starożytności tradycję uprawiania filozofii, w której stawia się pytania o całość; filozofia pyta o to, co to jest "byt w ogóle", byt "w całości"; filozofia prawa stawia pytania o to, co to jest prawo "w całości", prawo "w ogóle" . Podejmuje wprost fundamentalne zagadnienia należące do zasadniczych dziedzin filozoficznych – epistemologiczne, ontologiczne, etyczne, nie stroniąc także od zagadnień z zakresu logiki. Uprawiana przez niego filozofia ma charakter systemowy, co sprawia, że jej zrozumienie zakłada ujęcie całości propozycji. Sam Kaufmann uważa, że systemy filozofii prawa należą już do historii, jednak ta uwaga jest o tyle jedynie trafna w odniesieniu do niego samego, że jego filozofia prawa – w zgodzie z jego deklaracjami – nie zmierza do „gotowych rozwiązań” konkretnych kwestii prawnych, ale zmierza do ukształtowania pewnego sposobu refleksji nad prawem. Jego koncepcja jest ważnym głosem w sporze klasycznego pozytywizmu z koncepcjami niepozytywistycznymi. Za prawo w pełnym tego słowa znaczeniu uznaje konkretne rozstrzygnięcie, co niewątpliwie łączy jego podejście z amerykańskim realizmem prawnym. Rekonstruowana przez Kaufmanna struktura procesu „urzeczywistniania” prawa, dokonywana w kontekście i na użytek kultury prawnej typu kodeksowego, kontynentalnego, uwyraźnia obecność elementów typowych dla kultury prawa precedensowego –wnioskowanie od przypadku do przypadku. Jednocześnie za istotny problem każdego porządku normatywnego uznaje uogólnienie. Jest to znamienny teoretyczny wyraz narastającej świadomości współwystępowania obok siebie zasadniczych elementów każdego z tych typów kultur prawnych. Kaufmann trafnie dostrzega, że w konkretnym rozstrzygnięciu są obecne elementy normatywne wykraczające poza to, co jest zawarte w aktach normatywnych. Podobnie jak Ronald Dworkin, Kaufmann wskazuje, że dokonujący rozstrzygnięcia, czy tego chce, czy nie, „stosuje” szereg elementów normatywnych spoza aktów normatywnych. Analizy prowadzą do wniosku, że propozycja Kaufmanna zawodzi, gdy przechodzi on do ontologicznych uogólnień, przede wszystkim przez brak uwzględnienia w swych podstawach takich punktów odniesienia, które są zewnętrzne wobec badanego procesu „urzeczywistniania” prawa. To, czym jest osoba, determinowane jest systemem prawnym i kulturą, w której prawo funkcjonuje. Przy takim ujęciu Kaufmann nie osiąga jednego z ważnych celów, do którego zmierzał, nie wskazuje kryteriów pozwalających stwierdzić, czy stopniowa – dokonywana zgodnie z odkrytymi przez hermeneutykę filozoficzną wymaganiami poprawnego rozumienia – zmiana normatywnego sensu systemu prawnego zmierza ku „ustawowemu bezprawiu”, czy też nie. Sperm donation is a widely accepted and increasingly common practice. In the standard case, a sperm donor sells sperm to an agency, waives his parental rights, and is absolved of parental responsibility. We tend to assume that this involves no problematic abandonment of parental responsibility. If we regard the donor as having parental responsibilities at all, we may think that his parental responsibilities are transferred to the sperm recipients. But, if a man creates a child accidentally, via contraception failure, we (...) tend to assume that the man does indeed have parental responsibilities. Assessing these contrasting conclusions requires a theory of parental responsibility. I analyze prevalent theories of what makes someone parentally responsible and show that none of these theories can withstand scrutiny. I propose a new theory of parental responsibility, which, I argue, is more plausible than the alternatives. My theory of parental responsibility is based on our ownership and control over hazardous materials, namely, our gametes. I show that neither my theory, nor the theories I reject, can support our contrasting intuitions. I conclude that sperm donors are fathers, with parental responsibility. I argue that the alternative conclusion, that neither sperm donors nor accidental fathers are parentally responsible for their resulting offspring, is less plausible. I then consider whether parental responsibility can be transferred and argue that it is far from clear that it can. Finally, I address objections and consider some practical implications of these views. (shrink)

Must principles of justice be practical? Some political philosophers, the “implementers,” say yes. Others, the “idealists,” say no. Despite this disagreement, the implementers and idealists agree on what “practical” means, subscribing to the “implementation-prediction” conception of practicality. They also seem to agree that principles of so-called “ideal theory” need not be IP-practical. The implementers take this as a reason to reject ideal theory as an approach to principles of justice, while the idealists do not. In this paper, I argue that (...) we should reject the IP conception of practicality. The implementers make a mistake, then, by requiring principles of justice to be IP-practical. But the idealists make a mistake, too, by rejecting in general the requirement that principles of justice be practical. For there is a plausible alternative conception of practicality that political philosophers should accept: the “experimentation-learning” conception. EL-practicality makes for a more realistic and epistemically accessible standard of practicality, and thus should be welcomed by the realistically-inclined implementers. It also preserves a crucial role for ideal theory, so should be welcomed by the idealists, too. (shrink)

Standard philosophical methodology which proceeds by appeal to intuitions accessible "from the armchair" has come under criticism on the basis of empirical work indicating unanticipated variability of such intuitions. Loose constitutivity---the idea that intuitions are partly, but not strictly, constitutive of the concepts that appear in them---offers an interesting line of response to this empirical challenge. On a loose constitutivist view, it is unlikely that our intuitions are incorrect across the board, since they partly fix the facts in question. But (...) we argue that this ratification of intuitions is at best rough and generic, and can only do the required methodological work if it operates in conjunction with some sort of further criteria of theory selection. We consider two that we find in the literature: naturalness (Brian Weatherson, borrowing from Lewis) and charity (Henry Jackman, borrowing from Davidson). At the end of the day, neither provides the armchair philosopher complete shelter from extra-armchair inquiry. (shrink)

Governments are subject to the requirements of justice, yet often seem to go above and beyond what justice requires in order to act in ways many people think are good. These kinds of acts – examples of which include putting on celebrations, providing grants to poets, and preserving historic architecture – appear to be acts of government supererogation. In this paper, I argue that a common view about the relationship between government, coercion, and justice implies that most such acts are (...) not supererogatory, but wrong. Many will find that conclusion unattractive, but rejecting the common view that implies it raises problems, too. (shrink)

This book explores the question of why there is something instead of nothing. Several responses to this question are possible, but only some of them address the question seriously, respecting its emotional aspects as well as its cognitive dimension. The author carefully distinguishes those answers that are truly satisfactory, in both respects, from those that are inadequate. It can be argued that the existence of the world has no explanation at all, or that there is a necessary being whose existence (...) is self-explanatory, or that the world exists because it has value. Each kind of response is defensible to some degree, and it is argued that where they are defensible, they have a common content. Incorporating aspects of both the 'analytical' and 'continental' traditions, this book also responds to several historical philosophers concerned with these questions, including Plato, Leibniz, Kant and Nietzsche. Using a case vignette as an illustration, an expanded framework for examining ethical issues in human service practice is proposed. The article argues that the helping relationship is multiply constructed through discursive fields, rather than being a given, and that the lens of ethics must be widened to understand both the highly contradictory nature of practice, with its accompanying paradoxes, and the broader structures that constrain and influence practitioners. The article draws on the centrality of the concept of ethical trespass (...) to recognize the inevitability of some level of harm in the application of human service work, despite intention or skill. At the same time, investigating workers' uses of resistance to the dominant discourses is suggested as a means to edge toward the reduction of trespass. (shrink)

In contrast with some recent theories of infinitesimals as non-Archimedean entities, Leibniz’s mature interpretation was fully in accord with the Archimedean Axiom: infinitesimals are fictions, whose treatment as entities incomparably smaller than finite quantities is justifiable wholly in terms of variable finite quantities that can be taken as small as desired, i.e. syncategorematically. In this paper I explain this syncategorematic interpretation, and how Leibniz used it to justify the calculus. I then compare it with the approach of Smooth Infinitesimal Analysis, (...) as propounded by John Bell. I find some salient differences, especially with regard to higher-order infinitesimals. I illustrate these differences by a consideration of how each approach might be applied to propositions of Newton’s Principia concerning the derivation of force laws for bodies orbiting in a circle and an ellipse. “If the Leibnizian calculus needs a rehabilitation because of too severe treatment by historians in the past half century, as Robinson suggests (1966, 250), I feel that the legitimate grounds for such a rehabilitation are to be found in the Leibnizian theory itself.”—(Bos 1974–1975, 82–83). Russell's concept of the self as relevant to semantics, distinct from the psychological concept, evolved from a judger with no complexity of relevance to semantics to a mind with much relevant complexity. The evolution transformed his semantic conceptions: He reassessed what constitutes intentionality, giving up his theory of acquaintance as the aboriginal intentional relation, favoring a contextually constituted intentionality in his theory of neutral monism. His anti-idealism extricated itself from an unwarranted antirepresentationalism. Truth went from being an adverb of acts (...) to an adjective of propositions. He formulated a theory of singular knowledge based on a relation of noticing that anticipated Kaplan's "vivid Names." But, although he saw that the judger-adjudged relation could not account for a judgment's unity, he did not discover what did unify it. Stenius and Geach discovered it in that complex state of the judger which underlies the judgment's verb. (shrink)

There is a considerable sub-literature, stretching back over 35 years, addressed to the question: Precisely which general terms ought to be classified as rigid designators? More fundamentally: What should we take the criterion for rigidity to be, for general terms? The aim of this paper is to give new grounds for the old view that if a general term designates the same kind in all possible worlds, then it should be classified as a rigid designator. The new grounds in question (...) have to do with excavating the connection between rigid designation and semantic structure. Under the label of scientific metaphysics, many naturalist metaphysicians are moving away from a priori conceptual analysis and instead seek scientific explanations that will help bring forward a unified understanding of the world. This paper first reviews how our classical assumptions about ordinary objects fail to be true in light of quantum mechanics. The paper then explores how our experiences of ordinary objects arise by reflecting on how our neural system operates algorithmically. Contemporary models and simulations in computational neuroscience are (...) shown to provide a theoretical framework that does not conflict with existing fundamental physical theories, and nonetheless helps us make sense of the manifest image. It is argued that we must largely explain how the manifest image arises in algorithmic terms, so that we can pursue a metaphysics about ordinary objects that is scientifically well founded. (shrink)
